<p>This morning in the U.S. District courthouse in Asheville, Marion Kent Covington through his attorney plead not guilty to the charges of conspiracy to commit wire fraud outlined in the Bill of Indictment read to him minutes earlier. Last week, his accused co-conspirator, Diane McKinny, plead not guilty to the same charges. Both cases are set for the September 4th docket. It is unclear at this time which case may be heard first. Judge Martin Reidinger is the scheduled to preside over that session. </p>
<p>Kent entered the courthouse at the earliest possible moment standing with the jurors at the door until it opened. Ramona Hall was Kent’s driver and escort for this hearing. She did the same last Monday for Diane McKinny. Brooke Covington was NOT present. My theory is she is seeking to avoid media exposure at all cost.<br />
<span id="more-7009"></span></p>
<p>As I stood outside the courtroom with other media representatives waiting for it to be unlocked, it occurred to me that this could be a scene repeated several more times this year. Three of the five businesses alluded to in the Bill of Indictment have been mentioned and/or processed into the courts. The question among the media representatives was which other two businesses will be named and their owners indicted. Will it be only two more? I have my ideas which I may share later.</p>
<p>Sitting in my normal spot on the bench, I saw Kent’s face as he reacted to the number of people already seated in the courtroom. He was visibly shocked. He uttered a phrase I could not make out. </p>
<p>The hearing began just before 9:00AM. Kent was read his rights and the Magistrate Howell began reading the Bill of Indictment. Again, he was very articulate and considerate of making sure Kent understood each part. The last part of the Indictment included a forfeiture money judgment sought by the United States for $309,600. </p>
<p>After the initial hearing, Magistrate Howell moved into the detention hearing. The attorney for the US did not seek to detain Covington and thus asked for a $500,000 unsecured bond as well as similar restrictions as were imposed on Jerry Gross, Jason Gross and Diane McKinny. This time there was a stern admonition to not talk to Diane about the case and if she tried to talk to him, Kent is required to report this to his probation officer. Violation of any of the many restrictions could result in a contempt of court charge along with a warrant for arrest being issued. </p>
<p>Interesting to note, Kent will also be allowed to travel to South Carolina. His home(s), vehicles, cell phone and any computer or storage device for data will be subject to search without obtaining a separate warrant. </p>
<p>My personal observations of Kent’s answers to the questions from Magistrate Howell were that the replies were weak and his voice sounded as if he had been praying loudly for hours. He displayed no alpha male strength or confidence. He appeared taken aback by the scene playing out before him as if he were viewing a bad movie or even a nightmare. I might be reading too much into his demeanor, but let’s admit these are some pretty serious charges and he faces prison time and a hefty fine in addition to the money judgment. </p>
<p>During the arraignment hearing, through his attorney, Kent plead not guilty. The entire process ended by 9:34AM. After the hearing, Kent’s attorney Steve Cash answered a few questions on the courthouse steps. He had not seen the evidence against Covington yet, and could not say if the scheduled court date of September 4th would be pushed back. </p>
<p>The summer of indictments moves on. Who is next? We will need to wait and see. My thoughts are this is not over. </p>

										<content:encoded><![CDATA[<p><strong>Diane McKinny pleads “not guilty” &#8211; given a $500,000 unsecured bond</p>

<p>Before the initial hearing started on Monday in front of Magistrate Judge Dennis Howell, the court atmosphere was relaxed and filled with conversations between McKinny’s defense attorney, <a href="https://www.facebook.com/mackmckellerlaw/" rel="noopener" target="_blank">Mack McKeller</a>, and other court participants. Mr. McKeller was obviously known by all of the regular court staff. He gave the court reporter a hug in the friendliest way and received a warm welcome from the Magistrate once everyone was in their place to start the hearing. </p>
<p>The hearing started at 10:13AM. Magistrate Howell led by outlining the order of the proceedings: there would be an initial hearing, a detention hearing and an arraignment. He started by asking Diane several introductory questions meant to establish her ability to hear, read and understand the procedures as each step occurred. He read a list of her rights including not saying anything and a right to jury trial as well as others.</p>
<p>Soon, he was into the reading of the multi-page Indictment which served as a foundation for the other steps taken during this session.<br />
<span id="more-7000"></span></p>
<p>As with Jerry Gross and Jason Gross, Magistrate Howell took extreme care and consideration to ask questions meant to secure Diane’s agreement that she understood the process unfolding. He read each word of the indictment which took a while. He was very engaged. I provided a copy of the Indictment in my last post and will not go over all of it here. Not mentioned in my last post was the forfeiture judgment sought for $309,660. This amount represents the sum of benefits believed by the investigators which was acquired by fraudulent means. </p>
<p>As procedure, the Magistrate advised Diane she had three choices for representation. She could represent herself. She could hire an attorney or she could apply for indigent status and after a review of a sworn and signed financial affidavit, she could be granted a court appointed attorney.  She chose to complete the financial forms and ask for a court appointed attorney- in this case it was Mr. McKeller. </p>
<p>The list of the requirements of the pre-trial release conditions were read by Magistrate Howell. Right away, complications began to surface. Diane McKinny is (still) employed as the “bookkeeper” for Kent Covington. During the time in question, she worked in those duties for three companies owned or managed by Marion “Kent” Covington- Diverse Corporate Technologies (DCT), Integrity Marble, Inc. d/b/a Integrity Marble and Granite and during the time in questions, Sky Catcher Communications, Inc. These were the companies listed in the indictment. </p>
<p>Her continued employment for Kent posed a problem in that a few of the affected DCT employees from the time period in question remain employed today. Discussions began to resolve this issue since McKinny is not allowed to talk to anyone who could be called as a witness in this case or possibly in other related cases. The Magistrate again, as in the Gross hearings, expressed the requirement for McKinny to strictly adhere to this condition. He warned her that if it is discovered that she talked with Kent, present employees or anyone else who is a witness in this case, except for her attorney and the investigators, her bond would be revoked, a warrant for contempt of court issued for her arrest and she could be sent to jail and possibly fined. </p>
<p>A major conundrum was discussed in that McKinny is still a part of the “church community” (Word of Faith Fellowship) of which many members are subject to several ongoing investigations. The Magistrate stopped short of telling Diane she could not go to work or go to church, but he emphasized again that she is forbidden to discuss this case except with her attorney or investigators. </p>
<p>The list of limitations on Diane in many regards mirrored those put upon the Grosses. These include but are not limited to restricted travel to the District of Western North Carolina and the District of South Carolina, giving up her passport and not apply for a new one, no firearms, no violations of the law including reporting if she gets speeding ticket, no consumption of alcohol, no doing drugs or hanging out with those that do, agreeing to random drug testing, agreeing to submit a DNA sample if requested. </p>
<p>Additionally, her home, car, cell phone, any computer she has access to – all are subject to random searches.  Also, she was to meet with a probation officer to discuss other limitations and requirements. </p>
<p>The major conundrum which surfaced with the Grosses and with Diane was how to limit the contact with those who may be witnesses in this case. Next Monday, this same complication will be discussed. A possible solution would be for their counsel to advise them that until the trial is over and the outcome known- listen to the services/sermons from home. Not as discipline, but as a precaution to keep them free from compromising conversations. </p>
<p>Kent’s indictment includes the allegation he used his authority within the church community to coerce compliance to the illegal scheme. Will it be prudent to advise Kent to take his church involvement over the phone?</p>
<p>During the arraignment hearing, McKinny plead not guilty and was issued a $500,000 unsecured bond. The court date was set for September 4th, 9:00AM courtroom 1. An “open file policy” on behalf of the U.S. Attorney was confirmed. This may speed up the defense’s access to the evidence or discovery held by the prosecution. </p>
<p>By 10:54Am, the hearing was complete. Diane had a couple of other meetings. Her attorney presented me and the other media with his card and said, No time to talk now, send me an email and I will answer questions as I can… “We will present a vigorous defense.”</p>
<p>Monday was a beautiful, hot and humid day in the mountains of Western North Carolina. In many ways, this day in U.S. District court served as a warm-up for next Monday. Kent Covington is cast as instigator and developer of this illegal scheme along with McKinny. For those familiar with both parties, who do you think took the lead in birthing the “scheme?” </p>
<p>One has to wonder if either of them will turn on the other as the main promoter or driving force behind these alleged crimes. Once each of their attorneys views the discovery and evidence against their client, will they strategize to reflect the guilt on the other defendant? Or will a new person be named as the master of the plan of fraud?</p>
<p> Adding to the complicated dynamics of the “church community” is Kent’s marriage to Brooke – who is known as top tier leadership within WOFF. Will these factors complicate things even more? </p>
<p>With the trial for McKinny set for September in front of Judge Martin Reidinger, one wonders who might be indicted in July. Appears there will be more fireworks in the days to come. </p>
<p>I believe the conundrums and complications will continue to multiply as more individuals are indicted. Members and business owners will decide if their loyalty to WOFF is worth the risk of jail time.  Has it come to this? Yes, it has. The cost of being a faithful WOFF member is higher than many expected. Agree?</p>

Friday would my first trip to witness a session in this courthouse and I wanted to leave nothing to chance. <p>Thursday, I drove to Asheville and took pictures of the courthouse and asked questions of those working in order to be prepared for Friday. Friday would my first trip to witness a session in this courthouse and I wanted to leave nothing to chance. This move turned out to be worth the time and effort.</p>
<p>Friday’s schedule included a 9:15AM plea hearing for Jason Gross and a 10:00AM plea hearing for Dr. Jerry Gross. In front of these two hearings, another man was before Magistrate Judge Dennis Howell. This man was already incarcerated and was facing additional charges. His hearing ended and Jason Gross and his attorney took their appointed seats. </p>
<p>Before the Judge could address the plea agreement, he moved through several required steps including an initial appearance hearing and an arraignment. Jason was advised of his rights, informed of the charges, advised he could have a public attorney and told the difference between and indictment and bill of information.  Jason had already secured David B. Freedman as an attorney. Upon entering the courtroom, the Judge acknowledged Mr. Freedman and said it had been years since he had seen him. This was typically southern friendly.<br />

<p>Judge Howell was meticulous and detailed to administer each step of the proceeding with gravity and sincerity. At no time did he appear frustrated or in the least bit bothered with his duties. He read every document aloud and made sure Jason and Jerry understood each pivotal point of the proceedings. He navigated through the required legal steps with consideration for how the decisions made and documents signed today would affect Jason and Jerry for years to come. </p>
<p>Jason under counsel from his attorney waived the indictment and trial by jury process. At one point, the attorney for the U.S., Daniel V. Bradley was required to tell the court what he believed could be proved if the case went to trial. Jason listened and was asked if he believed these things were true. He answered, yes.</p>
<p>The question on my mind was how could defrauding the State of North Carolina become a Federal case? It was explained that during the time period of 2009 to 2013, the US Federal government was supplementing the ability of the States including North Carolina to pay unemployment claims. When a benefit was issued, the funds were initiated by an ACH (automated clearing house) transaction through a Federal Reserve branch. There are 12 Federal Reserve branches in the US and none of them are located in NC. Therefore, the funds crossed state lines and became an “interstate commerce” transaction. Thus, the US government, more specifically the FBI became involved. The fraud was not just against the State of NC, but against the US government.</p>
<p>The plea agreement entered into was not read word for word. However, the main parts were reviewed by the Judge and he made sure Jason understood the scope of the agreement. Jason and his attorney signed the agreement. During the recap of the agreement, it was not disclosed that Jason was cooperating with the government. There was one point where the US attorney asked the Judge to require Jason not to discuss the case with other people stating this investigation was a part of a larger more broad investigation. The Judge requested a list of names of people he is not to speak with. US attorney Bradley grimaced and was not willing to mention names. </p>
<p>The Judge qualified the restrictions on discussing the case to mean Jason was to talk to no one other than his attorney and investigators. He was warned to not discuss this case even with Jerry. “You can talk about sports; you can talk about anything but not this case…” </p>
<p>US attorney Bradley stopped short of disclosing the other people involved in this investigation or the other facets of related investigations… for obvious reasons. </p>
<p>The conditions of Jason’s release also include submitting DNA sample if required, stay away from alcohol, drugs or those who deal drugs, look for employment, not breaking the law, appear in court when required, a $200,000 unsecured bond, surrender his passport, not apply for a new passport, travel only in the western district and middle district of NC plus South Carolina. </p>
<p>He has to get rid of any guns, submit to random searches of his home, car and electronic devices. He also consented to a money judgment equal to the amount of benefits he received, $38,084.</p>
<p>The entire process for Jason took over an hour. After a short recess, it was Jerry’s turn. His process was basically the same. The amount he received in benefits was larger $43,036. The money judgment was for that amount. Instead of seeking employment, the judge asked if Jerry was retired. The list of restrictions mirrored Jason’s, a $200,000 unsecured bond, forfeit his passport, restricted travel and most assuredly- do not discuss this case with anyone except your attorney and investigators. He was reminded to not discuss this with Jason. </p>
<p>One difference in Jerry’s hearing, the US attorney mentioned in paragraph six of the plea agreement, Jerry was assisting the government as requested. (not a direct quote) However, what many had suspected was now said in open court- Jerry was telling the whole truth. When I heard that statement, I punched the person beside me who was also taking notes. In reality, I believe Jason is doing the same as his father. Why not? There is no bonus for holding back now. They could have been facing multiple counts and took the conditional plea to cooperate and lessen their sentence. This is even more likely since the “Factual Basis” document listed “RG” and “TG” as receiving $34,087 and $34,072 in unemployment benefits. Could this be Jerry’s wife, Bobbie (her nickname) and Jason’s wife, Tonya Gross? Did Jerry and Jason agree to plea to keep their wives out of the legal spotlight or worse?</p>
<p>As I write this, it is the wee hours of Saturday morning. Social media has been ablaze for hours with news reports and comments from ex-members and observers. The AP posted a summary article outlining how we got to this point. This release circulated near and far. Local television reports showed film clips of the two couples walking into the courthouse. At least one station interviewed the attorneys for Jason and Jerry. There has been time to reflect on the happenings of the day and how events may unfold in the months ahead. </p>
<p>Just a few hours ago, I realized my level of respect for Jason Gross and Jerry Gross increased after today’s hearings. No, I don’t believe they care what I think. However, I saw two men admitting to the court and the world that what they did was wrong. They were willing to be forthright and face the consequences. Are these actions closer to what some consider biblical teaching? Is this closer than when accused, taking the course to deny, deny, deny and delay, delay, delay? The evidence was apparently very strong and rather than deny it, they decided on admitting and working out a best case solution for them and their wives. </p>
<p>Of course, I have not talked to either of them and I might be totally off on this point. But for now, I believe Jason and Jerry Gross can sleep better tonight knowing they have done the best in a very negative and gloomy situation. If I could shake their hand and look them in the eyes, I would and from the bottom of my heart say- Thank you.</p>
<p>The course of events which were set in motion with the first AP release February 27, 2017 did not end today. In my opinion, things will move forward at a faster pace. This may just be the hottest summer on record in Spindale, NC. </p>
