Matthew Fenner Subpoenaed Again in Unrelated Case

Friday afternoon a Motion to Quash was filed in Rutherford County in the Anderson vs. Anderson divorce/custody case. (16 CVD 253). The Motion filed by attorney Paul Ditz seeks relief from the subpoena served on Matthew Fenner for a deposition hearing August 31, 2016 in Chapel Hill, NC. Ditz’s Motion included statements about the ongoing harassment of Matthew by members of Word of Faith Fellowship (WOFF) and their newest puppet attorney- Robert K. Denton. The Anderson vs. Anderson case involves Nicholas Anderson a present WOFF member versus Sarah Covington Anderson a former WOFF member.

Motion to Quash

Mr. Denton also represents Adam Bartley in the criminal case for Matthew Fenner’s allegations concerning incidents from January 27, 2013. In that case, five present and/or former members of WOFF were indicted on charges including second degree kidnapping, simple assault and assault inflicting injury by strangulation. These defendants include Brooke Covington, Justin Covington, Sarah Covington Anderson, Robert Lewis Walker, Jr. as well as Adam Bartley. The criminal case has been drawn out by pretrial motions and appeals. The next hearing date for the case is not known, but the most notable outcome thus far has been the Disqualification of WOFF bred attorneys – Joshua Farmer and Mark Morris and all their associates from representing any of the five defendants. Thus, we now see evidence of a puppet attorney – the honorable Robert Denton.

Thursday, October 8, 2015, in Rutherford County Superior Court there was a hearing held in the civil case brought by Robert Lewis Walker Jr. and Sarah Covington Anderson against Jerry Cooper Rccatalyst.com wrote about the case here when telling about the arrest of Jerry Cooper in the criminal case brought by Jane Whaley which was dismissed on May 29th. Mediation in the civil case did not bring a solution. The civil case surrounds Jerry Cooper’s Facebook posting commenting on the WRAL story of Matthew Fenner’s story of the events of from January 27, 2013. The issues in front of the court Thursday included a subpoena of the phone records of Danielle Cordez and Matthew Fenner.

One of the obvious differences on Thursday was the absence of any other WOFF members except Mark Morris, Hannah Davies and one other young WOFF member sitting in the attorney area. Mark Morris spoke as the lead attorney for Walker and Covington. Attorney Paul Ditz represented Jerry Cooper in this case.

About 2:12PM, Mark Morris leads off the session. The issues discussed included the requirements to obtain phone records from Ms. Cordez in Florida. In the end, this issue was not concluded as Judge Davis required more information from the attorneys. The process for an out of state party to obtain private records from a Florida resident is more involved than in North Carolina.

In the session, the definitions of libel and defamation were reviewed and rules quoted. During the discussion of the subpoena of Matthew Fenner’s records, Judge Davis asked, “Who Is Matthew Fenner?” In retrospect, the question did not mean, “I don’t know about Matthew Fenner.” I believe this was a way to get information into the court records about Mr. Fenner and related matters. Subpoenas, the Motion to Disqualify and NC Deed(s) of Trust (updated)

The Summer of Decision rolls on….

Friday, July 31, 2015; Rccataylst.com in article (rccatalyst.com) broke the news concerning the subpoena served on Ray Farmer as Vice President and Treasurer of Word of Faith Fellowship (WOFF). The subpoena requires for delivery of certain DVDs, audio or videos made January 26-28, 2013 on the premises of WOFF to the Rutherford County Superior Court on or before August 3, 3015 at 9:30AM. The document also requires all videotapes, audio, DVDs or video made July 1 through July 31, 2015 to be turned over. A third part of the subpoena includes any audio, CD’s DVD’s, videos papers, photos any other media depicting Richard Matthew Fenner, III. Read the document for a more complete description.

This is a very inclusive request. As far as I know, this is the first time WOFF has been issued such a request. Will there be lights on all night this whole weekend at the WOFF grounds? Will there be a last minute hardship request for an extension of time? What creative excuses will be given if such a request is made? The subpoena outlines a requirement for Ray Farmer to appear and testify on Monday. What will he be testifying to? Will he be required to swear under oath that the materials presented are all inclusive and nothing has been overlooked, modified or tampered with? Will he be required to attest to the validity, integrity and completeness of the submitted recordings? What if there are gaps in time sequence? How will this affect the acceptance of the materials? Will the papers be redacted? If so, what reason will there be for such redaction? Will tapes be scrambled? Questions, questions.

The delivery date for the required materials coincides with the hearing on Monday, August 3, 2015 for the State’s Motion to Disqualify Counsel. The State is moving to disqualify the entire firm of Tomblin, Farmer and Morris, P.L.L.C. from representing the five named defendants in the Fenner case. Jerry Cooper- Not Guilty- Jane Whaley Testifies

In courtroom number one at the Rutherford County courthouse; yet, another drama unfolded Friday pitting Jane Whaley, leader of Word of Faith Fellowship (WOFF) against one of her previously beloved, former members- Jerry Cooper. In 2013, Jane swore out criminal warrants against Jerry for counts of harassment by telephone, and cyberstalking (via text messages). For many reasons, I missed the first half of the proceedings. Upon arrival, I was informed Jane and her team were offered mediation in the morning and promptly refused the option. The case went on to the hearing phase.

Before the noon recess, the opening volleys include four quick objections by Cooper’s attorney, Paul Ditz which were subsequently sustained by Judge Dennis John Redwing. Josh Farmer testified and Jane Whaley took the stand before for about twenty minutes the break for lunch. The courtroom was closed when I arrived about 1:50PM. Jerry and his team were waiting at the door unsure when the proceedings would restart. A few minutes later, the room was opened by the bailiff. She kept conversation going during the wait for the judge’s return.

Again, as in times past, I sat on the right side of a courtroom with a reporter in front of me, advocate to my right and another supporter sitting behind me. Jayne Caulder was so kind to join us on the front row of Jerry’s side. I am not sure why. Jane Whaley and her entourage sat on the left side behind the table for the District Attorney, Roger McCalman. Before the proceedings began there were a few eerie, awkward, mostly silent moments. The clock was high up the far wall to my left and I found myself constantly looking UP and over to avoid any potential eye-locks with the WOFF entourage. My clock watching was motivated by thoughts of returning to work and if today’s matters would be settled by the time I needed to leave.
